OWCP vs Colorado Workers' Comp — What Denver Federal Workers Must Know
One of the most expensive mistakes an injured federal employee in Denver can make is walking into a Colorado state workers' comp clinic. FECA — the federal workers' compensation system — is not the same program, has different rules, and pays through the U.S. Department of Labor, not Pinnacol or a state carrier. Why Federal Employees Can't Use Colorado's System
FECA is the exclusive remedy for federal civilian workplace injuries. If you're a VA nurse, a letter carrier, a TSO at DIA, or a BLM employee at the Denver Federal Center, you cannot file a Colorado state workers' comp claim for a work injury — even if the state clinic tries to accept you. Your claim will be denied, and any delay in filing with OWCP can cost you benefits.
The Practical Consequences
- A Pinnacol-network provider is unlikely to know how to bill DOL or complete a CA-17.
- State-form work restrictions don't satisfy OWCP — you need the federal forms.
- Being 'released to full duty' by a state clinic before OWCP evidence is on file can undermine your CA-7 wage-loss claim.
- Time you spent at the wrong clinic is time your OWCP case wasn't building supporting medical evidence.
What About Contractors?
Federal contractors — including many workers at Buckley SFB, the DFC, and VA — are generally covered by Colorado state workers' comp, not OWCP. Check your employer of record: if your paycheck comes from a private company, you're likely on the state system. If your SF-50 says federal civil service, you're OWCP.
